Get An Award-Winning Legal Team On Your Side

Each year, more than 13,000 taxis carry over 240 Million passengers in New York City. At some hours during the day, taxis can make up nearly half of the vehicle traffic in Manhattan. With so many taxis on the road, there is a chance you may be involved in a taxi accident, whether as a passenger, pedestrian or driver. In these situations, you may wonder what happens next. Who is going to pay for your injuries and damages?

At Jaroslawicz & Jaros, our NYC injury attorneys have more than 300 years of combined experience in personal injury law. Taxi accidents are just one of many types of injury situations we are capable of handling. We have litigated many cases and recovered more than $2 billion, with hundreds of our clients receiving $1 Million or more in compensation. If you plan to take legal action to recover compensation for your injuries, retain a firm with a proven record of success. Contact us today!

The NYC Taxicab Passenger Bill Of Rights

The NYC Taxi & Limousine Commission establishes a set of rights for taxicab passengers. These rights include what you may expect from your driver, as well as the conditions of the taxicab. If these rights are violated, the Taxi & Limousine Commission allows individuals to file a complaint. It is important to know your rights as a taxicab passenger, because in an accident, one or more violations of these rights may contribute to the success of your claim for compensation.

The taxicab passenger bill of rights gives you the right to the following:

  • A courteous and safe driver who obeys all traffic laws
  • A driver who does not operate a cellphone while driving
  • A driver who speaks English and possesses knowledge of city geography
  • Working seat belts for each passenger
  • A trip free of noise (honking, radio, etc.)
  • Clean air (smoke-free and scent-free)
  • Accompaniment by service animal
  • Directing the specific route that the driver takes
  • To go to any destination in NYC, Newark Airport, Nassau or Westchester

Claiming No-Fault Insurance Benefits

In New York, drivers are required to have driver insurance coverage that covers “basic economic loss," which is a maximum of $50,000. In the case of an accident with other insured drivers, your own insurance automatically covers your injuries and damages without establishing fault in the collision. This is often referred to as no-fault benefits. You may claim no-fault benefits in a taxicab accident as a driver, passenger or pedestrian.

However, if you are uninsured or other drivers are not insured, you may not be able to claim no-fault benefits. This may be fixed by having uninsured motorist coverage or by making a claim with the taxicab’s insurance. If you receive compensation from no-fault benefits, you may not be able to recover compensation in a separate lawsuit against the negligent driver. Before making a decision regarding your claim, discuss your options with our NYC personal injury lawyers and ensure that your case secures the compensation you need.

Filing A Lawsuit For Taxi Driver Negligence

If you have been injured, your primary focus should be on obtaining the compensation you need to recover. While no-fault insurance benefits can be a quick procedure, they may not cover the full costs of your injuries. If you suffer catastrophic injuries or lose a loved one to wrongful death in a tragic accident, a no-fault insurance claim may not cover your pain and suffering and other additional expenses. If you can prove that someone’s negligence is to blame for the accident, you may be able to obtain compensation not only for the medical costs and damages, but also for your loss of wages, earning capacity and out-of-pocket expenses.

Holding a negligent or reckless driver accountable may include proving the following:

  • The individual was negligent and/or reckless in his or her duties.
  • The individual’s negligent/reckless behavior resulted in the accident.
  • The accident caused you injuries and damages.
